AML/CTF Program Development and Independent Reviews

If you are a reporting entity, you must have an Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) program specifying how you comply with AML/CTF legislation. The program must be a written document showing how you identify, mitigate and manage the risk of your products or services being used for money laundering or terrorism financing, and must be appropriate to the level of risk your business or organisation may reasonably face.

Regulated entities must have Part A of their AML/CTF program independently and regularly reviewed. Your risk assessment helps you plan your independent reviews. How often you do this, depends on the size of your organisation, and the nature and complexity of your business.

An independent review is an impartial assessment of Part A of your AML/CTF program. It checks that you’re complying with your program and that it:

  • properly addresses your money laundering and terrorism financing risks
  • complies with your legal obligations
  • is working as it should.

We can help with:

  • Assessing the organisation’s AML/CTF risk-profile. This should be regularly reviewed and updated.
  • Ensuring board and senior management approval and their ongoing oversight of the program.
  • Appointing an AML/CTF compliance officer at the management level to manage your compliance with your obligations.
  • Development of an employee due diligence program to identify any employees who may expose your business to AML/CTF risk.
  • An AML/CTF risk awareness training program for employees so they know the risks to your business and what they must look out for.
  • Consideration of guidance material from AUSTRAC.
  • Systems and controls to make sure you meet your AML/CTF reporting obligations.
  • Ongoing customer due diligence (OCDD) systems and controls to make sure information collected about a customer or beneficial owner is reviewed and kept up to date, and to determine whether extra information should be collected and verified.
